Skateboard, Scooter, Skates and Bicycle Ordinance
Be it ordained that the City Council of Eastport hereby ordains the following ordinance titled skateboard, scooter, skates, and bicycles.
1. PURPOSE
The purpose of this ordinance is to provide for the orderly operation of Skateboards, Scooters, Skates, and Bicycles within the City, and to specifically prohibit their use within certain areas designated within the Downtown Development District (DDD).
2. DEFINITIONS
2.1 CITY – The City of Eastport, Maine
2.2 DOWNTOWN DEVELOPMENT DISTRICT (DDD) - That portion of the City
designated as the Downtown Development District (DDD) per the following
description and the Attachment "A" map as they maybe amended from time
to time. District DDD extends from the North, at the intersection of Sullivan
Street and Water Street, to the South at Key Street, from the East at Seawall
and Walkway to the West, one block from Water Street respectively on Key
Street @ Green Street, Dana Street @ Green Street, Boynton St. @ Furniture
Avenue, Washington Street @ Elm Street and including the Breakwater,
Overlook Park, the Fish Pier, and the Fish Pier Parking Lot.

2.3 SKATEBOARDS, SCOOTERS, SKATES, and BICYCLES - Vehicles used for the
propulsion of people by human power, not subject to registration under state motor
vehicles laws, including but not limited to bicycles, scooters, skateboards, roller
skates, and roller blades. This designation does not include any device operated
by a person or a person directly assisting a person, who is unable to walk or
otherwise ambulate without the assistance of a human-powered conveyance.
2.4 OPERATE — To ride upon, drive, propel or otherwise convey one self or others
on skateboards, scooters, skates, and bicycles.

3. RESTRICTED
3.1 RESTRICTED AREA
3.1.1 Operating to Endanger – No person shall operate a skateboard, scooter,
skates, or bicycle so as to endanger any pedestrian on any public way or
in such a manner as might discourage any pedestrian from the peaceful
use of such public ways or in such a manner as to interrupt the smooth
flow of automobile traffic.
3.1.2 Sidewalks - No person shall operate a skateboard, scooter, skates, or
bicycle on any sidewalk, or public walkway, as that term is defined at
17-A M.R.S.A. 505, as amended, in the area designated as the
Downtown Development District (DDD).
3.1.3 Overlook Park - No person shall operate to skateboards, scooters,
skates, and bicycles on Overlook Park at anytime.
3.1.4 Breakwater - No person shall operate skateboards, scooters,
and skates, on the Breakwater at anytime. (Revised – 04/21/2003)
3.1.5 Fish Pier - No person shall operate skateboards, scooters, and
skates, on the Fish Pier at anytime. (Revised – 04/21/2003)
3.1.6 Fish Pier Parking Lot - No person shall operate skateboards,
scooters, and skates on the Fish Pier Parking Lot at anytime.

3.1.7 Operation Prohibited – The operation of skateboards, scooters,
and skates, is prohibited, at times other than special events
created by or approved by the City Council, in the area

4. VIOLATIONS AND PENALTIES
4.1 Violation of this article may be punishable by a civil penalty of not less than twenty-five ($25.00) and not more than two hundred ($200.00) or by impoundment of the vehicle which was operated in the commission of such violation for a period not to exceed thirty (30) days or both. Community service is considered a viable alternative at the discretion of the courts for payment of fines.
