Article III - CITY MANAGER
Section - 3.01 Appointment; Qualifications; Compensation.
The Council shall appoint a city manager for a term of one year specified by contract and fix his his/her compensation. The manager shall be appointed solely on the basis of his his/her executive and administrative qualifications. He He/She need not be a resident of the City while in office only with the approval of the council.
Section - 3.02 Removal.
The Council may remove the manager from office in accordance with the following procedures:
The council shall adopt by affirmative vote of a majority of all its members, a preliminary
resolution, which must state the reasons for removal and may suspend the manager from
duty for a period not to exceed forty-five days. A copy of the resolution shall be
delivered promptly to the manager
A copy of the resolution shall be delivered promptly to the manager. Within five days after a
copy of the resolution is delivered to the manager, he he/she may file with the council a written
request for a public hearing. This hearing shall be held at a council meeting not earlier that than
fifteen days nor later than thirty days after the request is filed. The manager may file with the
council a written reply not later than five days before the hearing.
The council may adopt a final resolution of removal, which may be made effective immediately,
by affirmative vote of a majority of all its members at any time after five days from the date
when a copy of the preliminary resolution was delivered to the manager if he he/she has not
requested a public hearing, or at any time after the public hearing if he he/she has requested
one.
The manager shall continue to receive his his/her salary until the effective date of a final
resolution of removal.
Section - 3.03 Acting City Manager.
During his his/her absence or disability of the city manager, the city council shall designate a qualified person to exercise the powers and perform the duties of the manager during his his/her temporary absence or disability; the council may revoke such designation at any time and appoint another officer of the City to serve until the manager shall return or his his/her disability ceases.
Section - 3.04 Powers and Duties of the City Manager.
The city manager shall be the chief administrative officer of the City. He He/She shall be responsible to the council for the administration of all city affairs placed in his his/her charge by or under this charter. He He/She shall have the following powers and duties:
(1) He He/She shall appoint an official of the City who shall have the title of city clerk. The
city clerk shall give notice of the council meetings to its members and the public, keep
the journal of its proceedings and perform such other duties as are assigned to him
him/her by this charter or by the city manager.
(2) He He/She shall appoint and, when he he/she deems it necessary for the good of
the service, suspend or remove all city employees and appointive administrative
officers provided by or under this charter, except as otherwise provided by law, this
charter or personnel rules adopted pursuant to this charter. He He/She may authorize
any administrative officer who is subject to his his/her direction and supervision to
exercise these powers with respect to subordinates in that officer's department, office
or agency.
(3) He He/She shall direct and supervise the administration of all departments, offices and
agencies of the City, except as otherwise provided by this charter or by law.
(4) He He/She shall attend all council meetings and shall have the right to take part in
discussion but may not vote.
(5) He He/She shall see that all laws, provisions of this charter and acts of the council, subject to enforcement by him him/her or by officers subject to his his/her direction and supervision,
are faith-fully executed.
(6) He He/She shall prepare and submit the annual budget and capital program to the council.
(7) He shall prepare and cause to be distributed to each taxpayer of the City an annual report for the City of Eastport. (Revised 12-08-86) He He/She shall prepare and make available to
the public an annual report of the City of Eastport.
The report shall contain:
A complete report on the finances and administrative activities of the City during the fiscal
year immediately preceding;
A full report from each of the City's administrative officers, elected or appointed, detailing
the transactions and activities of his his/her department during the preceding fiscal year,
as well as his his/her evaluations of these activities of his his/her department and
recommendations for the future.
(8) He He/She shall make such other reports as the council may require concerning the
operations of City departments, offices and agencies subject to his his/her direction
and supervisions.
(9) He He/She shall keep the council fully advised as to the financial condition and future
needs of the City and make such recommendations to the council concerning the affairs
of the City as he he/she deems desirable.
(10) He He/She shall perform such other duties as are specified in this charter or may be
required by the council.
(11) He He/She shall be responsible for maintaining a complete and current inventory of
all City property, capital equipment, as well as all other materials and supplies.
(12) He He/She shall conduct all sales of property belonging to the City which is unfit or
unnecessary for the City's use but only after such sale has been authorized and
advertised by the City Council, and subject to such restrictions as the City Council
may by resolve provide; except when the owner of his his/her immediate family has
paid taxes, interest and all other costs in full before such advertisement.
