Splitting or Merging Property

Eastport ordinance requires that you merge your non conforming lots!
 
3.2.7.3 Contiguous Lots-Vacant or Partially Built
3.2.7.3.1 If two or more contiguous lots or parcels are in single or joint ownership of record at the time of or since adoption or amendment of this Ordinance, if any of these lots do not individually meet the dimensional requirements of this ordinance or subsequent amendments, and if one or more of the lots are vacant or contain no principal structure, the lots shall be combined to the extent necessary to meet the dimensional requirements.
 
Procedure for Splitting or Merging Property
 
In order for us to merge property you must meet the following criteria:
  1. Property MUST be contiguous to each other;
  2. All parcels MUST be in the same name, trust or business;
  3. Parcels MUST be in the same taxing district; and
  4. Person requesting the merge MUST be the current owner of the properties.
  5. You  need to record the new parcel in a deed with the  in the Washington County Registry of Deeds.
In order for us to split property you need to meet the following criteria:
  1.  Person requesting split MUST supply our office with a complete legal description and/or survey of the way the property is to be split out;
  2. Person requesting the split MUST be the current owner of the property; and
  3. Taxes MUST be paid in full.
  4. You  need to record the new parcel in a deed with the  in the Washington County Registry of Deeds.
 
We will split or merge your property as long as you supply us with the legal description. Our office will not create or draft property descriptions.
The Assessor’s Office STRONGLY suggests that you contact the Code Enforcement Officer to verify whatever you are asking us to do will meet the current zoning requirements.
 

The entire process can take approximately 1 to 2 weeks depending on what time of year the request is made. Our office realizes that other agencies depend on verification from our office. We will supply a letter from our office confirming the split or merge. The letter will contain the parcel numbers, corresponding legal description of the property, property or E911 address and the name of the person requesting the split or merge.
